Terms of Service

1. Agreement to Terms

By accessing or using NOVAScanner ("the Service"), including both the web application and iOS mobile application, you agree to be bound by these Terms of Service ("Terms"). The Service is owned and operated by Endev LLC ("we," "us," or "our").

2. Description of Service

NOVAScanner is an AI-powered food scanner that analyzes food images to detect and classify processed foods using the NOVA classification system. The Service includes:

  • Food image scanning and analysis
  • NOVA classification results
  • Processing score calculations
  • Scan history storage
  • Cross-platform access (web and iOS)

3. Account Terms

3.1 Account Creation

  • You can use Google Sign-In on both web and iOS platforms
  • iOS users can also use Apple Sign-In
  • You must provide accurate information
  • You are responsible for maintaining account security

3.2 Account Usage

  • One account per user
  • You may not share your account
  • You must be 13 years or older to use the Service
  • You may access your account across multiple devices

4. Subscription and Payments

4.1 Free Tier

  • Limited number of free scans
  • Basic features
  • No subscription required

4.2 Paid Subscriptions

  • Plus Tier: $4.99/month
  • Professional Tier: $9.99/month
  • Web app payments processed through Stripe
  • iOS app payments processed through Apple's App Store
  • Automatic renewal unless cancelled

4.3 Subscription Management

  • Web app subscriptions can be managed through your account settings
  • iOS subscriptions must be managed through your Apple ID account settings
  • Subscriptions purchased through Apple's App Store are subject to Apple's Terms of Service

4.4 Refunds

  • No refunds for partial billing periods
  • Refunds for web app purchases issued at our discretion
  • Refund requests for iOS app purchases must be directed to Apple

5. User Content

5.1 Your Content

  • You retain rights to your uploaded images
  • You grant us license to use uploads for Service operation
  • You are responsible for your uploaded content
  • Content may be synchronized across your devices when signed in

5.2 Prohibited Content

  • Illegal or harmful content
  • Misleading information
  • Content violating others' rights
  • Non-food content that may interfere with service functionality

6. Intellectual Property

  • NOVAScanner and related marks are our property
  • Service content is protected by copyright
  • You may not copy, modify, or reverse engineer the Service
  • You may not distribute or make unauthorized derivative works of the application

7. App Store Terms

For iOS users, your use of the NOVAScanner application is also subject to Apple's Terms, including:

  • The App Store Terms of Service
  • The license to use the app is limited to a non-transferable license to use on Apple-branded products
  • Apple has no obligation to provide maintenance or support services
  • In the event of any failure of the app to conform to warranty, you may notify Apple, and Apple may refund the purchase price
  • Apple is not responsible for addressing claims relating to the app
  • Apple is a third-party beneficiary of these Terms

8. Device Permissions

To use certain features of the iOS application, you may need to grant the following permissions:

  • Camera access for food scanning
  • Photo library access for selecting images
  • Network access for data synchronization

You can revoke these permissions at any time through your device settings, but doing so may limit functionality.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

WE DO NOT GUARANTEE THE ACCURACY OF FOOD PROCESSING CLASSIFICATIONS OR NOVA SCORES, WHICH ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON FOR MEDICAL DECISIONS.

10. Limitation of Liability

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST SIX MONTHS.

NOTHING IN THESE TERMS EXCLUDES LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

12. Termination

We may terminate or suspend your account and access to the Service:

  • For violations of these Terms
  • For any unlawful behavior
  • To protect our Service or other users
  • At our sole discretion

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms that should survive termination shall survive termination.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via:

  • Email notification
  • Service announcement
  • Posted notice on our website or within the app

Continued use of the Service after changes constitutes acceptance of modified Terms.

14. Governing Law

These Terms are governed by the laws of New Mexico, United States, without regard to its conflict of law principles.
